VISA® CHECK CARD AND
ATM CARD CARDHOLDER
AGREEMENT AND DISCLOSURE STATEMENT
This Agreement explains how you can use your VISA® CHECK CARD or ATM CARD, and it sets forth your rights and responsibilities. In this Agreement, "you" refers to the cardholder and "we" refers to Adams County National Bank.
Your Responsibility and Authorized Use. You will be bound by this Agreement, and to any modifications thereof, by application for and your first use of your VISA CHECK CARD or ATM CARD after you receive this Agreement. Any such modifications shall become effective and be binding 30 days after notice of the modification is posted, except where the Electronic Fund Transfer Act provides otherwise.
The VISA CHECK CARD or ATM CARD remains our property and must be surrendered immediately to us upon our request. You can not transfer your VISA CHECK CARD or ATM CARD to another person, and we may cancel and revoke your card at any time without notice to you. If you attempt to use your card after it is canceled or revoked, it will be retained. For your protection, your VISA CHECK CARD or ATM CARD may also be retained in situations where it appears that there is, or may be, a danger of loss, theft or unauthorized use.
No electronic fund transfers may be made, and no transaction that you attempt to initiate will be completed, if your VISA CHECK CARD or ATM CARD is damaged, has expired, has been canceled or revoked, or is retained for any reason. If you use your VISA CHECK CARD or ATM CARD to access an account that is no longer available or lacks sufficient funds to complete the transaction, we may, at our sole discretion, charge or credit the transaction to another of your accounts.
Never allow anyone to use, borrow or obtain your VISA CHECK CARD or ATM CARD and Personal Identification Number, or PIN. By giving your card and/or PIN to another person, you take responsibility for all transactions made by that person, or by anyone else to whom that person gives the card and/or PIN, until you notify us to cancel your card and issue a new card. To maintain the security of your account(s), you agree not to write your PIN on your card and not to keep your PIN any place where it may be found with your card. Further, we will rely upon use of your PIN as validating your directions when used with your VISA CHECK CARD or ATM CARD just as your actual signature.
Pulse® ATM Services. You may use your VISA CHECK CARD or ATM CARD in conjunction with your Personal Identification Number, or PIN, at automated teller machines to conduct any of the following transactions for each of the accounts you have requested to be accessed by your VISA CHECK CARD or ATM CARD:
- Withdraw cash from:
1) your designated checking (either CareFree, Esteem, Relationship, Checking +, NOW and/or SuperNOW) account(s) and
2) your designated savings (either Statement Savings and/or Money Market) account(s).
- Deposit cash or checks at ATMs bearing the Pulse logo to:
1) your designated checking account(s) and
2) your designated savings account(s).
- Transfer funds between:
1) your designated checking account(s) and
2) your designated savings account(s).
- Obtain the available balance from:
1) your designated checking account(s) and
2) your designated savings account(s).
- Make payments at our ATM(s) by enclosing cash or checks and the payment coupon for those items (such as loan or savings club accounts) that are normally accepted at any office of Adams County National Bank.
Some ATMs may only provide access to the accounts you have designated as your primary checking or savings account. Since account balances are updated periodically, they may not reflect some of the most recent transactions involving your designated accounts. Not all ATMs may accept deposits. There may also be limits on the amount of funds which you may deposit at certain ATMs.
CIRRUS® Services. You may use your VISA CHECK CARD or ATM CARD with your PIN at any CIRRUS automated teller machine (CIRRUS ATM) located throughout the United States and foreign countries to conduct any of the following transactions that are available at the CIRRUS ATM:
- Withdraw cash from:
1) your checking account and
2) your savings account.
- Transfer funds between:
1) your checking account and
2) your savings account.
- Obtain the available balance from:
1) your checking account and
2) your savings account.
These are the present services available from the CIRRUS network, but other services may be provided in the future as they are developed. The above transactions are only applicable to the accounts which you list on your VISA CHECK CARD/ATM CARD application form and designate as the primary account of each account type, or such other primary accounts which are added later at your written request.
Other ATM Network Access. From time to time, we may make arrangements with other ATM networks to grant access to VISA CHECK CARDs or ATM CARDs.
Purchase Transactions. You may use your VISA CHECK CARD with signature authorization for purchases at any retail establishment, or merchant, that accepts Visa. You may also use your VISA CHECK CARD or ATM CARD with your PIN at those merchants where ATM CARDs are accepted to purchase goods and services and/or obtain cash where permitted by the merchant. The amount of all such purchases (including any cash obtained, if permitted) is deducted from your primary checking account. When you make a purchase using the VISA CHECK CARD or ATM CARD, you are requesting us to withdraw funds from your selected primary checking account in the amount of the purchase and directing or ordering us to pay these funds to such merchant. Any purchase refund made by a merchant is posted to your primary checking account. Foreign currency transactions are converted to U.S. dollars under the then current applicable rules of VISA International.
Limitations on the Use of Your VISA CHECK CARD or ATM CARD. You may use the VISA CHECK CARD to withdraw up to $500.00 each day or the ATM CARD to withdraw up to $500.00 each day at ATMs which we inform you are available for you to use from your account(s), provided the funds are available in your account(s). In addition to the amount that you may withdraw in cash each day, you may use the VISA CHECK CARD for purchases up to $1,500.00 each day or the ATM CARD for purchases up to $500.00 each day. The total amount of your cash withdrawals and purchase transactions each day may not exceed $2,000.00 using the VISA CHECK CARD or $500.00 using the ATM CARD. Further, you may not use the VISA CHECK CARD or the ATM CARD for any illegal transactions.
The day for withdrawal and purchase limits starts at 3:00 p.m. each calendar day and ends at 3:00 p.m. the next calendar day. There are also certain limitations on the frequency of use of the VISA CHECK CARD or ATM CARD each calendar day. These limitations are imposed and not revealed for security purposes.
You will be denied the use of the VISA CHECK CARD or ATM CARD if you exceed the daily cash withdrawal, purchase and/or overall debit limit; do not have adequate funds available in your account(s); do not enter the correct PIN; or, exceed the frequency of usage limitation. The receipt provided by the ATM or merchant point-of-sale terminal will notify you of the denial. There is a limit on the number of such denials permitted. Attempts to exceed the limit may result in machine retention of your CARD at an ATM. The number of attempts that may result in machine retention is not revealed for security reasons.
If Your Card is Lost or Stolen. If you believe your VISA CHECK CARD, ATM CARD or your PIN has been lost or stolen, or that an unauthorized transfer or purchase from any of your accounts has occurred or may occur, please contact Adams County National Bank immediately by calling or writing:

A new card may be issued to you at that time, and a "hold" will be placed on your old card. After such time, if you find your old card, you must notify us and return your old card to us. If you attempt to use your old card, it may be captured and retained by the ATM. Adams County National Bank will charge a replacement fee of $5 for a lost or misplaced card. Additionally, if expedited delivery or other special handling is requested, a fee of $25 will be assessed.
Charges for Transactions. There are no fees currently assessed by Adams County National Bank for the use of a VISA CHECK CARD or ATM CARD in conjunction with Adams County National Bank ATMs. At ATMs not owned or operated by Adams County National Bank, cash withdrawal transactions are assessed a fee by Adams County National Bank of $1.00 per cash withdrawal. This fee is waived for Relationship Checking accounts. In addition, transactions at ATMs not owned or operated by Adams County National Bank may be subject to a fee assessed by the ATM terminal owner/operator and/or by an automated transfer network. A 1% Visa international transaction fee will be assessed on all transactions where the merchant country differs from the country of the card issuer. We reserve the right to institute additional fees, and to charge your account in accordance with the fee schedule to be provided to you at least 30 days prior to assessment or change in assessment.
Deposit, Payment and Funds Availability Information. Deposits and payments made at ATMs are posted to your account(s) according to the rules and regulations of the account(s) and our funds availability policies, which are contained in our disclosure statement required under the Expedited Funds Availability Act. A copy of the Bank's Disclosure of Funds Availability has been provided to you or is available upon request. You may not deposit any foreign currency. All deposited items are removed from the ATM before 3:00 p.m. each business day.
Adams County National Bank reserves the right to verify the items so deposited before such funds are made available to you; however, you may withdraw against the amount deposited up to $100.00. When all of the deposited funds become available, you may withdraw against the entire amount deposited up to the daily withdrawal amount.
You may deliver cash, checks and other items at most PULSE ATMs located in Pennsylvania, Delaware, Maryland and New Jersey for transmission to us for deposit to your account(s). However, some ATMs may not accept such items for deposit and certain other ATMs may limit the amount of funds you deliver for transmission to us for deposit to your account(s).
Payments using a deposit/payment envelope are only accepted at ATMs operated by Adams County National Bank. If the dollar amount on the item(s) presented differs from the amount you have indicated to the ATM, we will adjust your account(s) to reflect the amount we have received and advise you of any difference.
Record of Transactions. A printed receipt is available for each ATM or purchase transaction which you make at the time of the transaction. For Visa purchase transactions initiated via either the telephone or the Internet, a detailed receipt is generally not available. You will receive a monthly account statement(s) showing the status of your account(s), transactions made during the past month, including purchase transactions, and any fees which we may impose for such services or transactions. However, if you have no ATM transactions involving your designated savings account(s), you will receive an account statement(s) at least quarterly.
Your Liability for Unauthorized Transfers. CONTACT US OR FIFTH THIRD EFT CLIENT SERVICES IMMEDIATELY if you believe your VISA CHECK CARD, ATM CARD or PIN has been lost or stolen. Telephoning Adams County National Bank, toll free at 1-888-338-ACNB (2262) or locally at (717) 334 3161, or Fifth Third Processing Solutions, toll free at 1 800 528 2273, is the best way of keeping your losses to a minimum.
You could lose all the money in your account(s) if you take no action to notify us of the loss or theft of your VISA CHECK CARD, ATM CARD or PIN. If you notify us of the loss, your liability will be as follows:
- If you contact us within two business days of the loss or your discovery of the loss, you can lose no more than $50.00 if someone used your VISA CHECK CARD or ATM CARD and PIN without your permission.
- If someone used your VISA CHECK CARD or ATM CARD and PIN without your permission, you could lose as much as $500.00 if you do NOT contact us within two business days after you learn of the loss and we can prove that we could have prevented the loss if you had contacted us.
- Also, if your monthly statement shows transfers or purchases that you did not make and you do not contact us within 60 days after the statement was mailed to you, you may not get back any money lost after the 60 days, if we can prove that your contacting us would have prevented those losses. Extenuating circumstances, such as a long trip or hospital stay, may warrant an extension of the 60 day period.
When using your VISA CHECK CARD, the above liability limitations are modified for Visa purchase transactions. With Visa's Zero Liability Policy, if you notify us of the loss or theft of your VISA CHECK CARD, your liability for unauthorized Visa purchase or point-of-sale transactions is $0. Visa's Zero Liability Policy does not apply to ATM transactions or to PIN transactions not processed by Visa.
Business Days. Our business days are Monday through Friday. Holidays are not included.

as soon as you can, if you think your statement or receipt is wrong or if you need more information about a transaction listed on the statement or receipt. We must hear from you no later than 60 days after we sent you the FIRST statement on which the problem or error appeared. You must provide us with the following:
- Tell us your name, account number, and VISA CHECK CARD or ATM CARD number;
- Describe the error or the transaction you are unsure about, and explain as clearly as you can why you believe it is an error or why you need more information; and,
- Tell us the dollar amount of the suspected error.
If you tell us orally, we may require that you send us your complaint or question in writing within 10 business days. After we receive your inquiry, we will tell you the results of our investigation within 10 business days for ATM, purchase transactions or any transactions that were made outside of the United States, the Commonwealth of Puerto Rico or any political subdivisions thereof ("international transactions"), and will correct any error promptly. If we need more time, however, we may take up to 45 days for ATM transactions, or 90 days for purchase or international transactions, to investigate your complaint or question. If we decide to do this, we will recredit your account within five business days if it is a Visa purchase transaction, or 10 business days if it is an ATM or purchase transaction, other than Visa, or international transaction, for the amount you think is in error, so that you may have the use of the money during the time it takes us to complete our investigation. If, however, we receive an inquiry for an account that has been opened less than 31 days and you are a new customer, we will tell you the results of our investigation within 20 business days for ATM transactions, purchase transactions or international transactions, and will correct any error promptly. If we need more time, however, we may take up to 90 days to investigate your complaint or question. If we decide to do this, we will recredit your account within five business days if it is a Visa purchase transaction or 20 business days if it is an ATM transaction, purchase transaction, other than Visa, or international transaction, for the amount you think is in error, so that you may have the use of the money during the time it takes us to complete our investigation. If we do not receive your complaint or question in writing within 10 business days, we may not recredit your account.
If we conclude that there is no error, we will send you a written explanation within three business days after we finish our investigation. You may ask for copies of the documents that we used in our investigation. If we credit your account with funds while investigating an error, you must repay those funds to us if we conclude no error has occurred.
Disclosure of Account Information. We will disclose information about your account(s) or the transactions you make to third parties:
- when it is necessary to complete transactions;
- to verify the existence and standing of your account(s) with us upon the request of a third party, such as a credit bureau;
- in accordance with your written permission;
- in order to comply with court orders or government or administrative agency summonses, subpoenas, orders, examinations and escheat reports; and/or,
- on receipt of certification from a federal agency or department that a request for information is in compliance with the Right to Financial Privacy Act of 1978.
Evidence and Collection Expenses. If we go to court for any reason, we can use a copy, microfilm, microfiche or photograph of any document or person to prove what you owe or that a transaction has taken place, and the copy, microfilm, or microfiche will have the same validity as the original. If we ever have to file a lawsuit to collect what you owe us, you will pay our reasonable expenses including attorney fees.
Our Liability for Failure to Complete an Electronic Fund Transfer Transaction. If we fail to complete a transaction on time or in the correct amount, when properly instructed by you, we will be liable for damages caused by our failure unless:
- there are insufficient funds in your account to complete the transaction through no fault of ours;
- the funds in your account are unavailable;
- the funds in your account are subject to legal process;
- the ATM has insufficient cash to complete the transaction;
- your card has been reported lost or stolen and you are using the reported card;
- we have a reason to believe that the transaction requested is unauthorized;
- the failure is due to an equipment breakdown which you knew about when you started the transaction at the ATM or merchant point-of-sale terminal;
- the failure was caused by an act of God, fire or other catastrophe, or by an electrical or computer failure, or by another cause beyond our control;
- you attempt to complete a transaction at an ATM or merchant point-of-sale terminal which is not a permissible transaction listed above; or,
- the transaction would exceed security limitations on the use of your VISA CHECK CARD or ATM CARD.
In any case, we shall only be liable for actual proven damages if the failure to make the transaction resulted from a bona fide error, despite our procedures to avoid such errors. There may be other exceptions to our liability as stated in agreements with you. We will not be liable if we have terminated this Agreement.
Liability for Vandalism and/or Damage to Our ATM(s). You are also hereby made aware that you are liable for any acts of vandalism and/or damage caused by you to any ATM and its environs. You will be subject to prosecution and/or other legal action for damages in the event you commit such willful acts with the intent to damage or destroy the property.
Waiver of Agreement. Any waiver of any term outlined in this Agreement by us on any occasion will not prevent us from asserting that term on any other occasion. We may also terminate or amend this Agreement at any time.
